“Company”, “we”, “us”, “our” refers to Solar Boom Energy Pty Ltd, ABN: XX XXX XXX XXX, a registered Australian company operating in Melbourne, Victoria. “You”, “your”, “customer” refers to the person or entity requesting or receiving services from the Company. “Services” refers to solar system design, supply, installation, commissioning, and related support services.
1. Acceptance of Terms
By accessing our website or requesting a quote, installation, or any service from Solar Boom Energy Pty Ltd (“Company”, “we”, “us”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Services Provided
We provide design, supply, and installation of solar PV systems, battery storage systems, inverters, heat pump hot water systems, and EV chargers for residential and commercial properties in Melbourne, Victoria and surrounding areas.
3. Quotes and Pricing
All quotes provided are estimates based on information available at the time. While we strive for accuracy, there are cases where the project may cost more, and we will discuss these with the homeowner. Final pricing may vary depending on roof condition, switchboard upgrades, structural requirements, or distributor requirements discovered during installation. A binding agreement is formed upon your acceptance in writing.
4. Payment Terms
A deposit of 20% is required to secure your installation date and order materials. The remaining balance is due upon completion of the installation. For rebate-eligible installations, we can offer a rebate-assisted payment option where government rebates are deducted upfront, subject to eligibility verification.
5. Installation and Timeline
We will schedule your installation at a mutually convenient time. Installation timelines depend on equipment availability, weather conditions, and grid connection approval from your electricity distributor. We are not liable for delays caused by third parties or circumstances beyond our reasonable control.
6. Warranties
- All products are covered by manufacturer warranties as specified in your quote (typically 10-25 years)
- We provide a 10-year workmanship warranty on all installations
- Warranties are void if the system is modified, moved, or serviced by unauthorised parties
- Warranties do not cover damage from acts of nature, misuse, or negligence
- System monitoring must remain active for full warranty coverage
7. Your Responsibilities
- Provide accurate information about your property, electrical system, and energy usage
- Ensure safe access to your property and roof for our installation team
- Obtain any required body corporate or strata approvals (we can assist with documentation)
- Be present or have a representative present on installation day
- Inform us of any known hazards (asbestos, fragile roofing, etc.)
- Pay the agreed amounts according to the payment schedule
8. Cancellations and Refunds
- You may cancel your booking within 5 business days of signing the agreement for a full refund of any deposit paid.
- Cancellations between 5-14 days may incur a fee to cover materials ordered, with balance refunded.
- Cancellations after 14 days or within 7 days of scheduled installation will forfeit the deposit.
- We reserve the right to cancel or postpone installations due to unforeseen circumstances, with a full refund provided.
9. Limitation of Liability
To the maximum extent permitted by law, our liability for any loss or damage arising from our services is limited to the cost of the service provided. We are not liable for indirect, consequential, or special damages, including lost profits, data loss, or any damages arising from your use or inability to use installed systems. For installations where your electricity importer changes, your feed-in tariff is determined by your electricity retailer, and we are not responsible for FIT rates.
10. Intellectual Property
All designs, proposals, system layouts, and documentation prepared by Solar Boom Energy remain our intellectual property. You may not use, copy, or distribute these materials for any purpose other than your own residential solar installation.
11. Dispute Resolution
- In the event of a dispute, please contact us in writing within 7 days of becoming aware of the issue.
- We will attempt to resolve the matter through good-faith negotiation within 14 days.
- If the dispute cannot be resolved, either party may refer the matter to Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal (VCAT).
12. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website with an updated date. Your continued use of our services after changes constitutes acceptance of the new terms.
Australian Consumer Law
Nothing in these terms limits your rights under the Australian Consumer Law. If you have a major problem with our services or a failure to meet a consumer guarantee, you are entitled to a remedy. These terms are in addition to your rights under Australian Consumer Law and do not limit them.
